Terms of Service

Draft outline — pending attorney review. Not yet binding.

This page is a placeholder. AhaMend is operated by KiteString LLC. The sections below outline what a Terms of Service for this product needs to cover, written to match the actual product behavior in code today — but the binding legal language must come from a licensed attorney (gate §1.6 in the Tier 1 compliance spec). Do not rely on this text as a contract.

1. Who operates this product

AhaMend is a parent-facing product for K–8 math gap diagnosis, operated by KiteString LLC (“we”, “us”). [ATTORNEY: confirm the correct contracting entity, registered address, and any required disclosures.]

2. Who can use AhaMend

AhaMend is for parents/guardians of K–8 students. Children do not create their own accounts — only a parent signs up, and the parent controls each child's profile and consent. [ATTORNEY: confirm age/eligibility language and any required representations the parent must make.]

3. What the product does (and doesn't do)

  • A parent submits a photo or text of their child's schoolwork.
  • The system extracts the problems, the parent confirms/edits them, and the system diagnoses likely learning gaps and suggests a short practice activity.
  • This is an educational support tool — not a substitute for a teacher, tutor, or formal assessment, and not affiliated with any school or district.

[ATTORNEY: add the appropriate "no warranty / educational aid only / not a diagnosis in the clinical sense" disclaimers.]

4. Billing, trials, and cancellation

[ATTORNEY + PRODUCT: this section depends on the Stripe integration (Tier 2.1), which is not yet live. Once billing ships, this section must state: trial length and what happens at trial end, price, billing cadence, how to cancel, and refund policy.]

5. Your account and content

You're responsible for keeping your login credentials secure and for the accuracy of the information you provide about your child. You may export or delete your child's data, or delete your account entirely, at any time from the Privacy & Data page.

6. Termination

Either party may stop using/offering the service at any time. [ATTORNEY: add standard termination-for-cause, suspension, and survival-of-terms language.]

7. Liability and disclaimers

[ATTORNEY: standard limitation-of-liability, "as is", and indemnification language for a US consumer SaaS product goes here.]

8. Governing law and disputes

[ATTORNEY: choice of law/venue, and whether arbitration/class-action-waiver clauses are appropriate for this product and price point.]

9. Changes to these terms

We may update these terms as the product changes. Material changes will be communicated before they take effect. [ATTORNEY: confirm notice requirements and whether re-acceptance must be captured — see §1.4 acceptance-tracking question.]
